The Government of Canada’s failure to adequately consult Indigenous Peoples on the Northern Gateway Pipeline demonstrates a disregard for both the requirements of Canadian law as established by section 35 of the Constitution and the requirement to respect the rights of Indigenous peoples to free, prior and informed consent as contained in the United Nations Declaration on the Rights of Indigenous Peoples.
